1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the CDLReach platform ("Platform") operated by CDLReach ("CDLReach," "we," "us," or "our") at app.cdlreach.tech. By accessing or using the Platform whether as a hiring company, a CDL driver applicant, or any other user you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Description of Service

CDLReach is a software-as-a-service (SaaS) platform that enables commercial trucking and transportation companies ("Companies") to recruit, screen, and manage CDL driver applicants ("Applicants"). Features include online driver applications, applicant tracking, electronic document management (eDocs), verification of employment (VOE), SMS and voice communications, and AI-powered recruiting tools.

CDLReach acts as a technology platform and service provider. We are not an employer, staffing agency, or party to any employment relationship between a Company and an Applicant.

4. Account Registration

Companies that wish to use CDLReach must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at mukhammad@cdlreach.com.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable federal, state, or local laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and FMCSA/DOT regulations
• Send SMS messages to individuals who have not provided prior express written consent
• Submit false, misleading, or fraudulent information in any driver application
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use the Platform to harass, spam, or harm any person
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Platform

6. Driver Applicant Terms

If you are a CDL driver submitting an application through CDLReach, you acknowledge and agree that:

• All information you submit is true, accurate, and complete to the best of your knowledge
• Providing false information may disqualify you from employment consideration
• Your application data will be shared with the Company whose position you applied for
• By checking the SMS consent checkbox, you provide your prior express written consent to receive autodialed and/or pre-recorded SMS text messages from CDLReach and the hiring Company to the mobile number you provided, regarding your CDL driver application status, document requests, interview scheduling, and other application-related communications
• You may revoke your SMS consent at any time by replying STOP
• Consent to receive SMS messages is not a condition of employment

7. Intellectual Property

The Platform and all content, features, and functionality including but not limited to software, text, graphics, logos, and icons are the exclusive property of CDLReach and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CDLREACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS PAID BY YOU TO CDLREACH IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising under these Terms shall be resolved through binding arbitration or, where arbitration is not available, in the courts of competent jurisdiction.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
